Terms of Use

These Terms are an agreement between you and Mina Technologies (“Mina”, “we”, “us”), Addis Ababa, Ethiopia, for the use of the Mina Property Management website, web app and mobile app (the “Service”). By creating an account or using the Service you accept them. If you are accepting for a company, you confirm you may bind it.

The agreement is made electronically, which Ethiopian law recognises under the Electronic Transactions Proclamation No. 1205/2020. Our Privacy Policy explains how we handle personal data and forms part of these Terms.

• Owner: the person or business that subscribes, owns or manages the properties, and holds the subscription.
• Manager: a person an Owner invites to help run some of their buildings, with the permissions the Owner grants.
• Tenant: a tenant, buyer or occupant whose account an Owner or Manager creates so they can see their lease, pay and send requests.
• Your Content: the information you or your team put into the Service.

• You must be at least eighteen and able to enter into a contract under Ethiopian law.
• Give accurate information and keep it up to date. Each account is for one person; do not share your sign-in.
• Keep your password safe and tell us at once if you think someone else has used your account. You are responsible for what happens under your account.
• An Owner is responsible for the Managers they appoint and what those Managers do in the Service.

Mina helps Owners record and manage properties, leases and sales, collect rent and utility bills, handle maintenance and expenses, and see reports. Depending on the plan, an account covers Rentals, Rentals + Utilities, or utility billing only. What each plan includes is described on our pricing page.

We improve the Service continuously and may add, change or remove features. We will not remove a core feature of your plan during a period you have paid for without telling you first.

• Every new Owner account starts with one free month on the plan chosen at sign-up, with that plan’s full limits. No payment details are needed to sign up.
• After that, the Service is paid in advance, monthly or yearly, at the prices on the pricing page in Ethiopian Birr. Rentals and Rentals + Utilities cost the same; issuing utility bills carries the per-tenant service fee shown there, paid when the bills are issued or ahead of time as bill credit, which pays only that fee and cannot be withdrawn. A year costs ten months.
• There are no automatic charges. Each renewal is a payment you choose to make. Paying before your period ends adds the new period to the time you have left.
• If a period ends without a renewal, the Owner can still sign in to renew, but Managers and Tenants under that account cannot sign in until it is renewed (a Tenant who also rents through another active account still can). We keep your data for a reasonable time so that you can renew without losing anything, and delete it as our Privacy Policy describes if the account stays closed.
• We may change prices. A change applies from your next renewal after we have given at least thirty days’ notice, never to a period already paid for. Owners who were subscribed before a price change keep their price for as long as they renew the same plan, unless we tell them otherwise.
• Each plan includes a monthly number of texts, shown on the pricing page, with a lower number during the free month: sign-in details for new Tenants, and notices of new bills when you choose to text Tenants about them. Unused monthly texts do not carry over. You can buy more texts in the app at the price shown there; bought texts are used once the month's run out, and do not expire. Past both, accounts are still created and bills still issued, and only the text is skipped — sign-in details are then shown to you to hand over yourself. A text is sent as soon as the account or bill exists, but delivery depends on the mobile network.
• Where VAT or another tax applies to your subscription, it is shown before you pay.

You can stop using the Service at any time by not renewing, and an Owner can close their account from their profile settings. Closing an account does not refund a period already paid for, except as below.

Where Ethiopian law — including the Electronic Transactions Proclamation — gives you the right to cancel an electronic transaction and be refunded, nothing in these Terms limits it. To use it, contact us within the period the law allows; we refund to the original payment method within thirty days of a valid cancellation. If we cancel your subscription without fault on your part, we refund the unused part of the period.

• Online payments are processed by Chapa, a licensed payment provider, and are subject to its terms. Mina is not a bank and does not hold deposits.
• Rent and bills a Tenant pays online are credited to the Owner’s balance in Mina, which the Owner withdraws to a bank account they have registered and verified. A newly registered bank account can receive money only after a 24-hour hold, to protect Owners from account takeover.
• Payments an Owner or Manager records by hand — cash, bank transfers — are the Owner’s own records. Late fees the Service suggests are only suggestions; the Owner decides what to charge.
• Mina is not a party to the lease, sale or occupancy between an Owner and a Tenant. Disputes about rent, deposits, the property or the lease are between them, and governed by the agreement they made and the law.
• Cancelling or deleting a recorded payment is reserved to the Owner, and a cancelled payment stays on record, marked cancelled.

As an Owner you are responsible for:

• having the right to record the personal data you put into the Service about Tenants and others, and telling them that you use Mina — you may point them to our Privacy Policy;
• the accuracy of the leases, rents, readings, payments and other information you enter, and checking the figures the Service calculates before you rely on them;
• complying with the laws that apply to your properties and your business, including rental, tax (such as declaring rental income and VAT where it applies), consumer protection and data protection law;
• what you send to Tenants through the Service, such as notices, reminders and bills.

You must not:

• use the Service for anything unlawful, fraudulent or misleading, or to harass or threaten anyone;
• enter information you have no right to use, or that is false;
• try to access accounts, buildings or data you have not been given, probe or test our security, or disrupt the Service — conduct that may also be a crime under the Computer Crime Proclamation No. 958/2016;
• upload malicious code, or content that infringes someone else’s rights;
• copy, scrape, resell or reverse-engineer the Service, except as the law allows.

You keep ownership of Your Content. You give us permission to host, copy, process and display it only as needed to run the Service for you, to keep it secure, and as the law requires. You can ask us for a copy of your data at any time.

How we handle personal data, how long we keep it and your rights over it are set out in our Privacy Policy.

The Service, its software, design, text and the Mina Property Management name and logo belong to Mina Technologies or its licensors. These Terms give you the right to use the Service for as long as you are allowed to, and no other rights. Suggestions you send us we may use freely.

We work to keep the Service available and your data safe, but the Service depends on networks, providers and payment systems we do not control, and we cannot promise it will always be uninterrupted or free of errors. We may pause it briefly for maintenance, and will try to give notice of planned work. Support is by email, phone and Telegram; Premium Owners get priority phone support.

The Service relies on others — Chapa for payments, an SMS gateway and the mobile operators for texts, app stores for the mobile app. Their terms apply to your use of them, and we are not responsible for their services.

We may suspend or close an account, with notice where practical, if it breaches these Terms, if it is used unlawfully or puts others at risk, or if the law requires it. We will give you a chance to export your data unless the law or the risk prevents it.

You may end the agreement at any time by closing your account. When an Owner’s account closes, the Managers’ and Tenants’ access to it ends too. Sections that by their nature should continue — such as payments owed, liability and governing law — continue.

Due dates, balances, late fees, utility splits, VAT figures and reports are calculated from what is entered into the Service. They are tools to help you, not legal, tax or financial advice. Check them before you act on them, and take professional advice where you need it.

To the extent Ethiopian law allows, we are not liable for indirect or consequential loss — such as lost profits, lost rent or lost data you could have exported — and our total liability to you for any claim about the Service is limited to the subscription fees you paid us in the twelve months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under Ethiopian law, such as liability for fraud, intentional harm or gross negligence, or any rights you have as a consumer.

If someone makes a claim against us because of Your Content, your breach of these Terms or your breach of the law — for example a Tenant’s claim about data you recorded without the right to — you will cover the reasonable costs and losses that result, to the extent the law allows.

We may update these Terms. If a change is significant we will tell Owners by email or in the app at least thirty days before it takes effect. Continuing to use the Service after that means you accept the new Terms; if you do not, you may close your account before the change takes effect.

These Terms are governed by the laws of the Federal Democratic Republic of Ethiopia.

If a dispute arises, contact us first and we will try in good faith to settle it within thirty days. If it cannot be settled, it will be decided by the competent courts in Addis Ababa. This does not take away your right to complain to a regulator, such as the Ethiopian Communications Authority for data protection matters.

• These Terms, the Privacy Policy and the plan you choose are the whole agreement about the Service.
• If any part is found unenforceable, the rest still applies.
• We may transfer this agreement to a successor of our business; you may not transfer it without our consent.
• If we do not enforce a right at once, we do not give it up.
• We send notices by email, SMS or in the app. These Terms are written in English; we can provide an Amharic translation on request, and if the two differ the English version applies unless Ethiopian law requires otherwise.
